The Dutch government's strategy is to slowly reopen certain parts of society that have been closed due to coronavirus. Childcare services and primary education will reopen on 11 May 2020, and young children will be able to attend sport activities again. Other measures – such as closing down restaurants and cafés – will remain in effect until at least 19 May 2020.
The government is trying to gradually open up our society to limit the economic blows to the economy. However, reopening the economy too quickly will possibly cause a substantial increase of new infections. By slowly creating a social distancing society, the Dutch government is trying to find the right balance between both interests.
Dutch employers and companies operating in the Netherlands are expected to contribute to this social distancing society. Employers are slowly starting up their businesses and operations again, and could be struggling with finding the right plan of approach for this. The following HR/employment law-focused checklist provides a step-by-step plan to help employers restart their businesses.
De strategie van de Nederlandse regering is het langzaam heropenen van bepaalde onderdelen van de samenleving die vanwege het coronavirus zijn gesloten. Op 11 mei 2020 gaat de kinderopvang en het basisonderwijs weer open en mogen kinderen weer sporten. Andere maatregelen, zoals de sluiting van restaurants en cafés, blijven van kracht tot ten minste 19 mei 2020. De regering probeert de samenleving geleidelijk weer te openen om de economische klappen voor de economie te beperken. Als deze heropening van de economie echter te snel wordt doorgevoerd zal dit mogelijk juist een aanzienlijke toename van nieuwe besmettingen veroorzaken. Door langzaamaan een maatschappelijke samenleving te creëren waarin afstand wordt gewaarborgd, probeert de Nederlandse regering de juiste balans te vinden tussen beide belangen.
Van Nederlandse werkgevers en bedrijven in Nederland, wordt verwacht dat zij een bijdrage leveren aan deze nieuw te creëren maatschappelijke samenleving, waarin afstand wordt gewaarborgd. Wij kunnen ons voorstellen dat werkgevers die bezig zijn met het hervatten van de bedrijfsvoering uitdagingen tegenkomen.
De volgende checklist biedt een stapsgewijs plan vanuit HR- en arbeidsrechtelijk perspectief, om werkgevers te helpen de bedrijfsvoering weer te hervatten na de lockdown.

For necessary contact between customers and the workforce, employers should arrange for necessary protective measures for both their own workforce and (where appropriate) customers. For example, this can be done by providing protective masks and (if necessary) gloves.
If workers travel by plane, it is possible that masks with a higher level of protection (FFP2 or FFP3) will be mandatory. Employers must also instruct their workforce in the correct use of protective clothing. They should meet these requirements in a timely fashion and order protective clothing as soon as possible; they should also consider issues such as reusability/cleaning and disposal of protective clothing.
A by-product of the protective and organisational measures introduced because of the pandemic could be companies have to adjust their personnel structure. Such adjustments may involve permanent changes in the organisation and/or working methods. Redundancy could follow and employment contracts could be terminated. Reorganising the company's business should be based on economic, technological or organisational measures.
Termination of employment contracts based on economic grounds will be difficult, considering the NOW. If the company is able to substantiate that organisational measures are necessary and not related to economic concerns, there will be a higher chance of success when requesting a dismissal permit from the Employee Insurance Agency (UWV). Redundancies are also subject to mass dismissal notification if the corresponding threshold values are exceeded.
Hoewel er strikt genomen geen verplichting bestaat om de aanbevelingen van het RIVM op te volgen, dient met deze aanbevelingen wel rekening worden gehouden in het kader van de te nemen gezondheidsbeschermende maatregelen bij het uitvoeren van de risico- inventarisatie en evaluatie. Het RIVM is ook wetenschappelijk verantwoordelijk voor beoordeling van de risicosituatie. Op iedere werkgever rust in dit kader een zorgplicht en op basis daarvan bestaat een verplichting om passende maatregelen (bijv. handwasregels en het reisverbod) te treffen en deze ook aan medewerkers aan te bevelen, op te leggen en deze zo nodig af te dwingen.
