10 Pitfalls in German employment law #20

German audit authorities have entered a new era of enforcement. With the rollout of KIRA, an advanced AI-powered audit tool, authorities can now systematically identify the misclassification of independent contractors — and the potential tax evasion that may follow. Other auditing authorities such as the German customs authorities follow that approach specifically targeting at generating higher volumes of withheld social security contributions and taxes. For years, misclassification carried significant criminal and financial risks for management, but limited auditing capacity reduced the likelihood of detection. That landscape has changed fundamentally. AI-supported reviews are dramatically increasing the probability of scrutiny — and enforcement.

In this webinar, we will not only explain the legal criteria distinguishing independent contractors from employees under German law but also especially outline a robust compliance and clearance process to avoid high fines and criminal liability risks for the management. Many organizations depend on highly specialized professionals — such as IT experts, engineers, and medical personnel — who often prefer freelance arrangements over traditional employment. However, what appears commercially practical may carry significant legal exposure if not properly structured and monitored.
