The European Parliament recently approved a revision of the European Works Councils Directive. This Directive provides for information and consultation for employees through European employee representation. The aim of the revision is to strengthen the position of the European Works Council (EWC) and improve consultation between the EWC and local works councils.
If your company is part of a multinational group, decision-making is not restricted by national borders. The same applies to employee participation. For cross-border employee participation, the rules are laid down in the European Directive on European Works Councils (1994). In the Netherlands, this Directive has been incorporated in the European Works Councils Act (WEOR). This law states, among other things, when establishing an EWC is mandatory and what rights the EWC has regarding information and consultation.
If the revision of the Directive is adopted, the WEOR will have to be amended accordingly. Although the introduction of the changes in Dutch legislation is still pending, it is advisable for the works council to know more about its role vis-à-vis the EWC. Voorstel herziening van de Richtlijn Europese Ondernemingsraden
Het Europese Parlement stemde onlangs in met een herziening van de Richtlijn Europese Ondernemingsraden. Deze richtlijn gaat uit van informatie en raadpleging voor werknemers door Europese medezeggenschap. Het doel van de herziening is om de positie van de Europese ondernemingsraad (EOR) te versterken en het overleg tussen de EOR en lokale ondernemingsraden te verbeteren.
Als uw onderneming onderdeel is van een multinationale groep, wordt de besluitvorming niet beperkt door de landsgrenzen. Dat geldt ook voor de medezeggenschap. Voor grensoverschrijdende medezeggenschap zijn de regels vastgelegd in de Europese Richtlijn Europese Ondernemingsraden (uit 1994). In Nederland is deze richtlijn nader uitgewerkt in de Wet op de Europese Ondernemingsraden (WEOR). In deze wet staat onder andere wanneer het oprichten van een EOR verplicht is en welke rechten de EOR heeft ten aanzien van informatie en raadpleging.
Als de herziening van de Richtlijn wordt aangenomen, moet de WEOR hierop worden aangepast. Hoewel de invoering van de wijzigingen in de Nederlandse wetgeving nog op zich laat wachten, is het voor de OR goed om meer te weten over zijn rol ten opzichte van de EOR.
