Whether as an employee or an employer, almost all of us have had to deal with the perennial issue of employment termination at some point. Thus, it is advantageous to gain a better understanding of this topic.
We will therefore discuss specific possibilities in a series of articles.
Under the Labour Code, an employment relationship* (whether it is fixed-term or permanent) may be terminated only:
- by agreement,
- by notice,
- by immediate dismissal,
- during the probationary period.
Logically, a fixed-term employment relationship also ends when the agreed period expires. However, if an employee continues to work after the agreed period, with the employer’s knowledge, this is regarded as permanent employment. Concerning fixed-term relationships, it is important to note that unlike that of certain other countries, Czech employment law does not enable employment relationships to end automatically and employers to serve notice accordingly when an employee reaches a certain age.
For the sake of completeness, it should be added that the employment relationship of a foreign national, if it has not been terminated as described above, also ends:
- on the date when their residence in the Czech Republic ends, in accordance with an enforceable decision to revoke the residence permit;
- on the date when a judgment on the expulsion of the foreign national from the Czech Republic took effect;
- upon expiry of the period for which a work permit was issued (e.g. employee card)
When unlawful dismissal should be challenged
An employer or an employee may challenge in court the validity of termination of employment (unlawful dismissal) by agreement, notice, immediate dismissal or by termination during the probationary period, no later than two months from the date when the employment should have ended, based on the termination. If this situation does not occur and the invalidity is not challenged in court within this period, the right to contest termination of the employment relationship expires. In such an instance, the employment relationship is regarded as having been terminated in accordance with the law.
Agreement is best
As always, an agreement between the employee and the employer offers the best solution; the parties can agree on the termination conditions. The Labour Code stipulates that they must do so in writing only and that each of the parties must receive one copy of the agreement. The reason for terminating the employment relationship need not be given.
What is the procedure if an employee is entitled to severance pay?
If an employment relationship is terminated and the employee is consequently entitled to severance pay (e.g. redundancy) under the Labour Code, they have a right to receive statutory severance pay, even if the agreement did not explicitly state a reason. However, if a legal dispute arises over a claim for severance pay, the employee must prove that a termination agreement had been executed, with reasons indicated. Giving or not giving a reason could have significance should the employee apply for unemployment benefit.
When does the employment relationship end?
The employment relationship terminates on the agreed date, regardless of other factors that would preclude notice being given (e.g. incapacity, pregnancy or maternity or parental leave).
The date when the employment relationship should end need not be determined merely by a calendar date. The date could be agreed on a different basis, e.g. upon the ending of a project in which the employee is participating, the end of sick leave, and suchlike. However, no doubt should arise about the agreed date when the employment relationship should terminate.
The agreed termination date of the employment relationship may be the date of signing of the termination agreement or one of the days following the execution date of the agreement, but not the day before the date signing date of such an agreement.
Nevertheless, if the employer and employee agree to terminate the employment relationship on the day preceding the execution date of the agreement, the employment relationship terminates on the day the termination agreement is executed.
What if the employee is already serving their notice period?
Likewise, the agreement may be executed during the notice period, i.e. only after the employee has received notice from the employer (or vice versa).
In practice, this happens, e.g. at the request of an employee who has already found a new position, or after giving notice, when the employee, with the employer’s consent, opts for a more advantageous form of termination. The employer can save costs, and an agreement can be a more viable option for the employee, especially in a case of breach of duty.
Notice (even if given properly) therefore becomes invalid because the employment relationship had already ended on the agreed date.
According to case law, it is lawful for an employer to justify termination of the employment relationship by stating that it believes that there are grounds for terminating the employment relationship with the employee, either immediately or by giving notice. However, we are of the opinion that reasons must exist. Proposing such an agreement could allow the employer to part with an employee “on the quiet” and thus avoid legal proceedings. Should a legal dispute arise, well-drafted agreements on terminating the employment relationship makes cases almost irrefutable.

Skončení pracovního poměru v České republice (část I.): Obecné informace a dohoda.
Skončení pracovního poměru je v podstatě evergreenem. V životě se s ním setkal a/nebo setká téměř každý z nás, ať už jako zaměstnanec či zaměstnavatel. Je tedy dobré se v této problematice alespoň trochu orientovat.
V rámci našich updatů bychom Vás proto postupně rádi seznámili s jednotlivými možnostmi.
Podle zákoníku práce může být pracovní poměr (bez ohledu na skutečnost, zda je pracovní smlouva uzavřena na dobu určitou či neurčitou) rozvázán jen
- dohodou,
- výpovědí,
- okamžitým zrušením,
- zrušením ve zkušební době.
Pracovní poměr na dobu určitou končí logicky také uplynutím sjednané doby. Pokračuje-li však zaměstnanec po uplynutí sjednané doby s vědomím zaměstnavatele dále v konání prací, platí, že se jedná o pracovní poměr na dobu neurčitou. V souvislosti s pracovním poměrem na dobu určitou je nutno upozornit, že na rozdíl od některých jiných států nemá Česká republika (pracovně)právní úpravu, která by při dosažení určitého věku zaměstnance jeho pracovní poměr automaticky ukončila či umožnila zaměstnavateli mu z tohoto důvodu dát výpověď.
Pro úplnost dodáváme, že pracovní poměr cizince, pokud k jeho skončení nedošlo již jiným způsobem, končí bez dalšího také
- dnem, kterým má skončit jeho pobyt na území České republiky podle vykonatelného rozhodnutí o zrušení povolení k pobytu,
- dnem, kterým nabyl právní moci rozsudek ukládající trest vyhoštění z území České republiky,
- uplynutím doby, na kterou bylo vydáno povolení k zaměstnání (např. zaměstnanecká karta).
Neplatnost rozvázání pracovního poměru je nutné zažalovat
Neplatnost rozvázání pracovního poměru výpovědí, okamžitým zrušením, zrušením ve zkušební době nebo dohodou může jak zaměstnavatel, tak i zaměstnanec uplatnit u soudu nejpozději ve lhůtě 2 měsíců ode dne, kdy měl pracovní poměr skončit tímto rozvázáním. Pokud se tak nestane a žaloba není v této lhůtě doručena soudu, právo napadnout rozvázání pracovního poměru zaniká a na pracovní poměr se hledí, jako by byl rozvázán v souladu se zákonem.
Dohoda je nejlepší
Dohoda zaměstnance a zaměstnavatele je téměř vždy nejlepším řešením. Strany se mohou dohodnou na podmínkách skončení. Zákoník práce předepisuje pouze písemnou formu a skutečnost, že každá smluvní strana musí obdržet jedno vyhotovení dohody. Důvod skončení pracovního poměru nemusí být v dohodě uveden.
Jak postupovat v případě nároku na odstupné?
Pokud by došlo k rozvázání pracovního poměru z důvodů, kdy podle zákoníku práce přísluší zaměstnanci odstupné (např. nadbytečnost), má zaměstnanec nárok na zákonem stanovené odstupné, i kdyby nebyl důvod v dohodě explicitně uveden. V případě soudního sporu ohledně vyplacení odstupného by však zaměstnanec musel prokázat, že k uzavření dohody o rozvázání pracovního poměru došlo skutečně na základě těchto důvodů. Uvedení či neuvedení důvodu může mít význam také v případě, že zaměstnanec po skončení pracovního poměru bude žádat o podporu v nezaměstnanosti.
Kdy skončí pracovní poměr?
Pracovní poměr skončí sjednaným dnem, a to bez ohledu na další skutečnosti, které by třeba bránily výpovědi (např. pracovní neschopnost, těhotenství, mateřská či rodičovská dovolená).
Datum, ke kterému má pracovní poměr skončit, nemusí být určeno pouze kalendářním dnem. Lze se dohodnout na určení konkrétního data i jiným způsobem, např. ukončením projektu, na kterém zaměstnanec pracuje, skončením pracovní neschopnosti zaměstnance apod. Nesmí však vzniknout pochybnost o sjednaném dni, ke kterému má být pracovní poměr rozvázán.
Sjednaným dnem skončení pracovního poměru může být den podpisu dohody o rozvázání pracovního poměru nebo některý ze dnů následujících po uzavření dohody, nikoliv ale den předcházející podpisu této dohody.
Dohodnou-li se zaměstnavatel a zaměstnanec i přesto na rozvázání pracovního poměru dnem, který předchází uzavření dohody, končí pracovní poměr dnem uzavření takové dohody o rozvázání pracovního poměru.
Co když zaměstnanec už je ve výpovědní lhůtě?
Je taktéž možné, aby dohoda byla uzavřena i v průběhu výpovědní doby, tedy až poté, co zaměstnanec obdržel od zaměstnavatele výpověď (nebo naopak).
V praxi se tak děje např. na žádost zaměstnance, který si již našel nové zaměstnání, nebo po doručení výpovědi, kdy zaměstnanec se souhlasem zaměstnavatele raději zvolí dohodu jakožto výhodnější formu skončení pracovního poměru. Zaměstnavatel může ušetřit náklady a pro zaměstnance může být dohoda, zejména v případě porušení povinností, schůdnější variantou.
Výpověď (ač platně daná) se pak už neuplatní, protože pracovní poměr již předtím skončil ke dni sjednaném dohodou.
Podle judikatury je v souladu s právem, jestliže zaměstnavatel svůj návrh na rozvázání pracovního poměru dohodou odůvodnil tím, že podle jeho názoru jsou zde důvody, pro které by mohl se zaměstnancem pracovní poměr zrušit okamžitě či výpovědí. Dle našeho názoru však tyto důvody musí skutečně existovat. Návrh na uzavření dohody může být ze strany zaměstnavatele způsobem, jak se „v tichosti“ rozloučit s problémovým zaměstnancem a zabránit možnému soudnímu sporu. Dobře sepsané dohody o skončení pracovního poměru jsou v případě soudního sporu téměř neprůstřelné.
