Taylor Wessing has won first instance proceedings before the Unified Patent Court (UPC) for its client Hanshow
The UPC found by its Local Division Munich in proceedings for granting preliminary measures regarding patent infringement in favour of Hanshow against SES-imagotag (SES). The court dismissed with decision of December 20, 2023 (file no. UPC_CFI_292/2023) SES-imagotag’s application for preliminary measures to prohibit Hanshow to offer and supply certain ESL products in the European contracting states of the UPC based on the alleged infringement of SES’ European patent EP 3 883 277 B1. The (non-final) decision includes some ground-breaking guidance on claim construction. The court followed the defendants’ argument that amendments to the claims made during the grant procedure are relevant for the interpretation of the claim language.
The decision in favor of Taylor Wessings’ client Hanshow underlines the law firm’s expertise in international patent litigation. In October Taylor Wessing was named “IP law firm of the year” by JUVE.
