The GenAI Transformation: What‘s left for Europe‘s Economy and how the law can help

The emergence of GenAI is transforming the digital industries, user behaviour and the way they find what they are looking for online at unprecedented speed. While this opens opportunities for new market entrants, many AI applications are pre-installed and bundled by dominant players on iPhones, WhatsApp, MS Office or other key platforms. This leads to significant competitive risks for other companies. In addition, AI chatbots are pushing entire business models out of the market.

Not only companies in the fields of generative AI, large language models, photo and video AI are affected. Search platforms for real estate and hotels, price comparison portals for insurance and electricity contracts, analogue business models like real estate agents and many more are exposed to serious risks. 

European antitrust law and the Digital Markets Act (DMA) are critical to open AI distribution channels and markets, support companies to defend themselves against competitive threats from AI giants and to compensate possible damages.
