Adjudication rules saga continues with Supreme Court granting leave to appeal Grove v S&T

Following on from our articles anticipating and following the Court of Appeal's decision in Grove v S&T, the saga may be set to continue following the granting of leave to appeal to the Supreme Court.

The Court of Appeal decision left some unanswered questions, particularly whether an employer could commence true value adjudication after commencement of a technical adjudication, but before receipt of the true value decision.

Should the appeal proceed, it is hoped that the Supreme Court will provide further clarification on the rules surrounding adjudicating the true value of an application following a successful "smash and grab" adjudication.
