Competitors can initiate summary proceedings or proceedings on the merits based on unfair competitions claims. In these proceedings, competitors can for instance request and/or claim:
- an interim injunction (in summary proceedings), including a penalty clause in case of breach
- compensation for damages
- rectifications/press releases
- order for payment of court fees and procedural costs.
Competitors can also initiate proceedings at the Advertising Code Committee, filing a complaint at the Advertising Code Committee, which Committee may recommend that the manufacturer no longer advertises in the manner complained about. In addition, it may issue a press release of the decision.
