On 28 April 2023, the government has published the Minister of Health’s regulation on the advertising of medical devices in Poland. This means that in just 14 days from this date the provisions detailing the new rules on the advertising of medical devices – in particular with regard to advertising to the general public – will finally enter into force.
The Regulation makes it clear what information must be presented to the public while advertising medical devices and how it must be presented. In particular, it contains detailed requirements for warning messages that must be included in any advertisements of medical devices to the public, as is the case with medicinal products advertising.
The most relevant rules for the advertising of medical devices according to the Regulation include:
- the obligation to provide information about the device that is consistent with its instructions for use and/or the label, and to do so in a clear and plain language (which is a clarification of the general prohibition on misleading);
- the requirement to include in the advertisement the name of the advertiser, the name of the manufacturer (and authorised representative, if applicable), and a warning stating: "This is a medical device. Use it in accordance with the instructions or label" - with detailed rules for the presentation of the above warning in audio-visual, audio and visual advertising;
- the obligation to communicate clearly the advertising nature of the message in the so-called influencer advertising and with regard to the sponsoring of events and the presentation of products at such events;
- clarification of the rules on advertising medical devices to the public:
a) in pharmacies and with regard to retailers - such advertising to be placed in a fixed and dedicated space and not to limit the area for customers; and
b) in healthcare facilities and doctors’ surgeries - where advertising is allowed in waiting rooms only;
c) in both of the above cases, advertising may not be in audio or audio-visual form.
The final text of the regulation is identical to the version of the act published in January this year. Compared to the original draft, there are therefore some simplifications to the rules for advertising to the public - including no need to indicate contra-indications for products in advertising or display/read out the full warning message.
The scope of the regulation also includes non-medical products referred to in Annex XVI of the EU Medical Device Regulation (MDR) (e.g. contact lenses or certain 'aesthetic' products). The rules on the communication of benefits obtained in the context of influencer advertising have also been simplified - according to the final version of the regulation, it is sufficient only to indicate the advertising nature of the communication, instead of having to provide detailed information on the benefits obtained.
An additional transitional provision has also been introduced according to which advertising, the dissemination of which started before the regulation came into force, and which does not meet the requirements set out therein, may be disseminated until 30 June 2023.
Alert prawny: Reklama wyrobów medycznych
28 kwietnia 2023 r. ogłoszono rozporządzenie Ministra Zdrowia w sprawie reklamy wyrobów medycznych. Oznacza to, że już 14 dni od tej daty przepisy doprecyzowujące nowe zasady prowadzenia reklamy wyrobów medycznych – przede wszystkim kierowanej do wiadomości publicznej – finalnie wejdą w życie.
Rozporządzenie określa niezbędne dane i sposób prezentowania reklamy wyrobów medycznych, zawierając przede wszystkim szczegółowe regulacje dot. niezbędnych w reklamie kierowanej do publicznej wiadomości ostrzeżeń na temat stosowania wyrobów medycznych, na analogicznych zasadach jak w przypadku reklamy leków.
Najistotniejsze reguły prowadzenia reklamy wyrobów medycznych według rozporządzenia obejmują:
- konieczność przekazywania danych dotyczących wyrobu w brzmieniu zgodnym z instrukcją używania lub etykietą, a także w sposób czytelny i wyraźny (co stanowi doprecyzowanie ogólnego zakazu wprowadzania w błąd);
- konieczność zawarcia w reklamie określenia podmiotu prowadzącego reklamę, nazwy producenta (i autoryzowanego przedstawiciela, jeżeli dotyczy), a także ostrzeżenia o treści: „To jest wyrób medyczny. Używaj go zgodnie z instrukcją używania lub etykietą” – wraz ze szczegółowymi regułami prezentowania ww. ostrzeżenia w reklamie audiowizualnej, dźwiękowej oraz wizualnej;
- obowiązek informowania o reklamowym charakterze przekazu w sytuacji tzw. reklamy influencerskiej oraz w odniesieniu do sponsorowania wydarzeń i prezentowania w ich trakcie wyrobów;
- doprecyzowanie zasad prowadzenia reklamy wyrobów medycznych kierowanej do publicznej wiadomości:
a) w aptekach, punktach aptecznych oraz placówkach obrotu pozaaptecznego – taka reklama ma być rozmieszczona w stałych i wydzielonych miejscach oraz nie może ograniczać powierzchni dla klientów; a także
b) w zakładach leczniczych i gabinetach – gdzie będzie można prowadzić reklamę wyłącznie w poczekalniach;
c) w obu powyższych przypadkach reklama nie może polegać na stosowaniu form dźwiękowych i audiowizualnych.
Ostatecznie przyjęty tekst rozporządzenia jest identyczny z wersją aktu opublikowaną w styczniu tego roku, po pracach Komisji Prawniczej. Względem pierwotnej wersji projektu zawarto zatem pewne uproszczenia co do zasad prowadzenia reklamy kierowanej do wiadomości publicznej - m.in. brak konieczności wskazywania przeciwskazań dla wyrobów w ramach komunikacji reklamowej, a także skrócenie wyświetlanego/odczytywanego ostrzeżenia.
Zakresem zastosowania rozporządzenia objęto również produkty bez przeznaczenia medycznego, o których mowa w załączniku XVI do europejskiego rozporządzenia MDR (np. soczewki kontaktowe, czy niektóre produkty „estetyczne”). Uproszczono także zasady informowania o uzyskanych korzyściach w ramach reklamy influencerskiej – wg finalnej wersji rozporządzenia wystarczające jest jedynie wskazanie reklamowego charakteru przekazu, zamiast konieczności podawania szczegółowych informacji w zakresie uzyskanych korzyści.
Wprowadzono także dodatkowy przepis przejściowy, zgodnie z którym reklama wyrobów, której rozpowszechnianie rozpoczęto przed dniem wejścia w życie rozporządzenia, niespełniająca wymogów w nim określonych, może być rozpowszechniana nie dłużej niż do dnia 30 czerwca 2023 r.
