Supervisors fail to strike out challenge to revoke a terminated CVA

Nick Moser and Alexander Tocili explore an English court's ruling that landlords have a legitimate interest in revoking a CVA where certain clauses could potentially continue to affect the Landlords after termination. The judge dismissed an application by the CVA's supervisors to have the revocation proceedings struck-out.

Change in the law regarding directors' personal liability

Melanie Jörg considers a German Federal Court ruling that prevents directors from being able to off-set any personal liability they incur against claims they bring for unpaid wages in an insolvency context.
