Whistleblowing in Poland – Q&A – 10 of 10 Insights

The Court of Justice of the European Union has issued a judgment against Poland for failing to implement whistleblower protection laws

On 25 April 2024, the Court of Justice of the European Union has issued a judgment against Poland for failing to implement whistleblower protection laws.

In a nutshell: The Republic of Poland has failed to fulfil its obligations and will pay to the European Commission: 

  • a lump sum of EUR 7 million;
  • in the event that the failure persists on the date of publication of the judgment, a daily penalty payment of EUR 40,000 from that date until Poland complies in full.

Meanwhile, the Polish Parliament on Wednesday 24 April 2024 sent the bill on the protection of whistleblowers was to the first reading in committees - to the Committee on Social Policy and Family. The deadline for the committee to report back is 20 May 2024. 

We can expect work on the bill to accelerate.

Wyrok przeciwko Polsce w sprawie braku implementacji przepisów o ochronie sygnalistów

25 kwietnia 2024 roku zapadł wyrok przeciwko Polsce w sprawie braku implementacji przepisów o ochronie sygnalistów: W skrócie: 

Rzeczpospolita Polska uchybiła swoim zobowiązaniom i zapłaci na rzecz Komisji Europejskiej:

  • ryczałt w wysokości 7 milionów EUR;
  • na wypadek, gdyby uchybienie utrzymywało się w dniu ogłoszenia wyroku, dzienną karę pieniężną w wysokości 40 000 EUR, licząc od tego dnia do chwili, gdy Polska położy kres temu uchybieniu.

Tymczasem w Sejmie w środę 24 kwietnia 2024 roku skierowano projekt ustawy o ochronie sygnalistów do I czytania w komisjach - do Komisji Polityki Społecznej i Rodziny. Termin przedstawienia sprawozdania to dopiero 20 maja 2024 roku

Możemy się spodziewać, że prace nad projektem ustawy pewnie przyspieszą.
