Brands Appeal cases L'Oréal v Bellure and Proctor & Gamble v Reckitt Benckiser

In two significant recent cases meriting the attention of brand owners, the English Court of Appeal clarified the limitations of trade marks and designs law as regards imitation products and comparative advertising.

L'Oréal v Bellure

Charts comparing smell-alike perfumes with fine fragrances and look-alike packaging are not trade mark infringement subject to reference to the ECJ. Read more

Proctor & Gamble v Reckitt Benckiser

Poor quality look-alikes convey a different impression and do not infringe original designs. Read more
