One of the most important methods of dispute resolution outside the courts is mediation.  The essential task of a mediator is to provide structural assistance with the negotiation process and to direct the negotiations in a constructive way using various techniques such as questioning and individual discussions with the parties.  The mediator does not however make a decision on the matter in question.  The outcome of the negotiations is determined by the parties.
