Designs
Registered designs provide a monopoly right which allows the holder the exclusive right to stop the use of the design on any products. Both registered and unregistered designs are a useful weapon in the brand owners' armoury against infringers and counterfeiters and provide additional solutions for brand owners. In some jurisdictions, product design may also be protected under unfair competition/passing off legislation as well as copyright law.
We have extensive experience of acting for clients both in contentious and non-contentious matters in this sector, and advise clients on the protection of their designs both nationally and on an EU-wide basis. We help them licence and exploit their designs, and also regularly act in cases where design rights have been infringed.
