Financial Services & Funds
The Taylor Wessing Financial Services and Funds Group is made up of dedicated practitioners in both of these core areas, together with a focus group of experts - in the UK, Germany and France - from practice groups around the firm who have experience in giving tailored advice in their specific disciplines to members of the financial services and funds communities.
The burden of regulation, both for funds and for the financial services industry generally, continues to grow evermore onerous. At the European level, the implementation of the Financial Services Action Plan - designed to enhance a single market in financial services across Europe - is now in full swing. On the back of this, each European member state is reviewing its domestic legislation. Internationally - particularly in the United States but also in the various offshore financial centres and generally around the globe - the fight against fraud and terrorism has led to increasingly more cumbersome layers of financial services regulation.

Regulatory regimes around the world continue to evolve rapidly and the burden of regulation grows. Taylor Wessing's Financial Services group provides specialist advice to financial institutions - domestic, European and international - on all of the issues which this throws up, as well as advising the firm's corporate and other clients when the rules impinge upon the way they go about their business.
In addition to highly experienced financial services specialists, the group includes experts from other disciplines around the firm. This enables us to provide financial institutions with all-round business solutions which take account of requirements specific to the industry, whether the advice involves employment, corporate or personal tax, discipline and enforcement, outsourcing or other issues.
Taylor Wessing's Funds group brings together teams from across the firm, combining financial services, corporate, finance, property and taxation expertise. This holistic approach sets us apart from other firms - as well as the structuring, creation and listing of funds, we advise on the tax, regulatory, marketing, corporate and other commercial issues which may affect the life of a fund.
Our focus is on funds established in offshore locations, but we also act for authorised funds located in the UK, Germany and France as well as other European jurisdictions. We have particular experience in relation to hedge and other investment funds, and to private equity, property, Islamic, and public private finance infrastructure funds.
In addition to acting for fund vehicles and their promoters, we regularly act for investors taking stakes, for example, in private equity and property funds. We regularly assist start-up fund managers to obtain their regulatory authorisation and provide managers with ongoing advice.
Taylor Wessing's Financial Services and Funds Group is alive to these challenges and well placed to meet them and to assist its clients in finding practical solutions which are both compliant with the rules and meet clients' business objectives.
