Finance litigation
The group regularly acts for banks and financial institutions in disputes arising in the context of insolvency and fraud, cross border disputes, documentary credits including letters of credits and bonds.
The strength of Taylor Wessing's finance litigation group lies with the technical ability of the specialists within the group and their commercial approach to dispute resolution. With our significant presence in UK, Germany and France, we are able to apply that approach more efficiently and effectively in cross border disputes.
We also pride ourselves on our negotiating skills and our ability to achieve effective settlements to avoid the protracted expense of court proceedings.
The finance litigation team is continuing to build on its track record of past successes including the successful defence of Financiera de la Republica SA of a claim brought by a UK bank (represented by Allen & Overy) in connection with the assignment of Ecuadorian government debt on the International forfait market and acting for a UK clearing bank against the claim that an internationally renowned dragway had been sold at undervalue.
During the last year we have settled a claim against a UK clearing bank involving complex issues of a bank's liability as a constructive trustee, settled multi-million pound fraud proceedings involving a foreign incorporated deposit taking bank and advised in respect of possible claims involving various overseas incorporated banks and the recovery of the proceeds of a US$ multi million fraud.
