In this context, market players must steer a course between the principles of competition and the free movement of goods on the one hand, and the protection of intellectual property rights on the other.
Combining the experience and resources of both our IP practice group and our Competition, Regulation and Trade practice, we are well placed to advise clients on how best to conduct their dealings in order to maximise returns while ensuring regulatory compliance.
We have experience in devising licensing and research & development agreements, which are often central factors in helping companies to develop and exploit their innovations effectively. Similarly, we are able to advise on access issues to certain inventions and the commercial and legal consequences thereof including such with regard to compulsory licences and essential facilities.
