Alternative Dispute Resolution (ADR)
ADR is increasingly becoming a method of choice to resolve IP and patent disputes in Europe. It offers absolute confidentiality, which is essential to protect valuable secret know-how, as well as flexible and effective procedures.
The ADR experts in our Patents group are recognised for the breadth and depth of their arbitration expertise. All members of the team are highly knowledgeable patent law specialists with a wealth of experience in proceedings before the recognised arbitration institutions, following the acknowledged rules of arbitration. Several members of the team hold degrees in life sciences and/or are trained mediators.
Our group acts for national and international parties in patent and licensing arbitration procedures before the well-known arbitration tribunals, such as ICC, WIPO or the German Institution of Arbitration (DIS). Several of our patent partners are listed as arbitrators in the recognised arbitration institutions and have gained in-depth experience acting as co-arbitrators or single arbitrators and chairing arbitration panels in accordance with the ICC Rules of Arbitration, the DIS Arbitration Rules and in ad hoc proceedings.
The services offered by the ADR teams of our Patents group include:
- advising on suitable ADR clauses in contracts and ADR agreements;
- representing clients in arbitration or mediation;
- advising in negotiations for, and the conclusion of, settlements;
- support in the enforcement of arbitration awards;
- conducting arbitration proceedings as members of arbitration tribunals.
