Finance Litigation
The Finance Litigation group is regularly instructed by UK, European and international banks, funds and wealth managers, and acts for banks and financial institutions and other financial institutions. Our banking and finance litigation practice experience includes disputes relating to:
- loan agreements, derivatives, CDOs, commodities, exchange traded securities and bonds
- recovery actions arising out of insolvent financial institutions
- mis-selling claims
- trade finance disputes
- regulatory investigations, in disputes arising in the context of insolvency and fraud, cross border disputes, documentary credits including letters of credits and bonds.
The strength of Taylor Wessing's Finance Litigation group lies with the technical ability of the specialists within the group and their commercial approach to dispute resolution. With our significant presence in UK, Germany and France, we are able to apply that approach more efficiently and effectively in cross border disputes.
The team is particularly experienced at early assessment of contentious issues and, whenever possible, we field lean teams that partner with the in-house business and legal personnel to provide strategic advice so as to resolve the matter quickly. If the matter cannot be resolved at an early stage, our specialist teams (who have the benefit of a deep understanding of national and international markets) manage litigation, arbitration and regulatory matters by reference to a clear plan for solving the dispute.
We understand, and are adept at managing, the challenges that these matters present to the business and legal teams of financial institutions because our team members have over 10 years of in-house banking experience. We pride ourselves on providing continuous costs and budgeting updates and take a flexible approach to structuring fee arrangements.
