Advertising and PR

Taylor Wessing provides legal advice for about 70 companies in the advertising and PR industry in Germany, the UK and France . Our client base covers the entire range in this diverse market sector, from major networks to owner-run enterprises and including holding companies, advertising and marketing agencies, trade associations and market research institutes.

The legal environment for agency services is very complex and changing constantly. As a pan-European practice, we are well placed to keep our clients informed of legal developments, above all with regard to the laws of the European Union.

A key element of our advisory service is to provide accompanying legal support in advertising campaigns. This includes the protection of individual ideas or entire concepts and how these may be put into practice without infringing third-party rights. In particular, we identify obstacles under competition law and make suggestions on how they can be overcome. In this respect, our familiarity with the special characteristics of individual trade sectors (such as food, pharmaceutical products or cosmetics) is of particular benefit to our clients.

As well as our advisory capacity, we also represent our clients in court disputes arising in connection with the legal admissibility of advertising ideas. In such a context, our knowledge of the latest advertising media and methods is crucial to our ability to deliver high-quality legal representation. The same applies to the specific marketing and distribution methods in the trade sectors in which our clients are working.

Taylor Wessing has a wealth of experience acting for the buyers and sellers of shares in advertising agencies. Most of the world's largest holding companies in the advertising world use Taylor Wessing in this respect, either directly or through subsidiaries. In particular, sellers of independent agencies benefit from our knowledge of common deal structures in the industry and the issues that arise in negotiations.

Finally, we are familiar with the agreements under which our clients serve their customers, buy ideas and material, and hire employees, freelancers and other service providers. As such, we act in negotiations for the conclusion of all such agreements, drafting, reviewing and revising them as necessary.
