As experience demonstrates in all jurisdictions, only a project concept tailored to the specific needs and goals of the planned transaction can form the basis for a later success. This common wisdom is even more true in China than in many other countries of the world.  Being a jurisdiction that is still partly fragmented with regulations on a local level varying from province to province, China provides additional hurdles that have to be carefully considered when structuring a potential project.  Whatever the reason, be it because the Chinese authorities will, in many transactions, want to be involved and to exert influence, or be it because the mentality of the Chinese people is so different, or because there is often quite a gap between theory and practice in China, failing to assess these factors right at the beginning may put a promising China related transaction at a high risk of failure.
