EGA Pre-Conference Seminar Pharmaceutical Patent Litigation Seminar:
A statistical and practical approach
Success or failure in pharmaceutical patent litigation often depends quite strongly on events that never end up being discussed in the final written judicial opinion. Indeed, success or failure often ultimately turns on situations and events that might have been unforeseen at the beginning of the litigation, which is why statistics of past cases can be very enlightening on what to expect in litigation.
In this completely new and revised Seminar, attendees will see statistics of past
pharmaceutical patent cases from the US, UK, Germany and the Netherlands, including rates of settlement, frequency of reversal on appeal, frequency of victories of generics and bases for such victories, and timing through final decision. These statistics and trends will be put into the context of the current (and possible future) legal frameworks of the respective countries.
After the introductions on patent litigation in the various jurisdictions, the attendees will be organized into smaller groups to work on a hypothetical pharmaceutical case, dealing with litigation strategy and various issues that arise when preparing and conducting proceeding in the various jurisdictions. Issues to be addressed may include (depending on country):
- timing of dossier/ANDA filing and projected approval
- value of the product versus cost of litigation
- infringement and validity issues
- settlement and authorized generics
- SPCs (Europe) and exclusivities (US)
