This High Court decision published this month may be of interest - Grisbrook v MGN and others (16 October 2009).
The case highlights the risks of publishing archive photographs online without ensuring that you have the right to do so. While a publisher may have the initial right to publish a photograph in a hard copy publication, it does not follow that it also has the right to publish the same photograph years later online.
