This month’s issue covers two interesting CJEU judgments which are particularly relevant to online publishers, as well as developments in the areas of consumer protection and net neutrality.
- CJEU ruling in the FAPL v Karen Murphy case
The long awaited CJEU ruling relating to territorial and copyright restrictions on broadcast content has been published. - CJEU ruling allows applicants to sue online publishers for pan-European damages for breach of privacy and infringement of personality rights in ‘centre of interests’
The CJEU has clarified European law and said that applicants can sue online publishers for pan-European damages for tort wherever their centre of interests lies as well as where the publisher is based. - EC continues on path to harmonisation of consumer laws
The EC has passed the Consumer Rights Directive and published its plans for the Common European Sales Law. - Net Neutrality and data protection
The net neutrality debate is hotting up again in the EU, not least in relation to the balance between the need of ISPs to manage internet traffic and the requirement to comply with privacy obligations.
