Allegations of workplace bullying have recently hit the headlines (again). To what extent is this issue of concern for employers, or is it all just more media hype pre a General Election?

Bullying in itself is not a ground for a claim to an Employment Tribunal, but complaints can be made under laws covering unlawful discrimination and harassment or, if it is the reason for leaving a job, bullying can be the subject of an unfair constructive dismissal claim.

In the last week, we have seen a rise in the number of employees claiming they are being bullied in performance management, and several cases where they have queried the absence of an appropriate policy.
