Marke has seventeen years' experience in structuring and completing some of the most significant deals in the London market and developing techniques that have become market standard. His experience includes securitisation of corporate loans, hire purchase and conditional sale contracts, equipment lease receivables, dealer finance receivables, swap receivables, residential mortgages, trade receivables, utilities and whole businesses. Marke also is a leader in the development of top-rated structured investment vehicles.
Highlights from Marke's deal list include:
- first UK CLO (NatWest's Thames Funding, 1992); first 'modern' SIV (Citibank's Centauri, 1996);
- first UK whole business securitisation (Welcome Break, 1997); first 'de-linked' UK CLO (Sumitomo's Aurora Funding, 1998);
- first use of master trust with originator trust over corporate loans (HSBC's Clover 1, 2000); first UK swaps securitization (Bank One, 2001);
- expert witness in a US$100 million High Court action for professional negligence by a major UK bank against a leading US law firm in connection with the structuring of a US$2 billion CBO (2006-2007); and
- advising Bank of Montreal on the provision of US$12.7 billion liquidity for two SIVs: Links Finance Corporation and Parkland Finance Corporation (2008).
Marke has published articles on legal, tax and accounting aspects of securitisation. He has been ranked among the top 20-securitisation lawyers in the world by Euromoney Institutional Investor and has been named as a leading expert in all of the major directories. Marke has spoken at many conferences around the world.
Marke's qualifications include an LL.M. from Trinity Hall, Cambridge (offered a tax fellowship at Queens' College, Cambridge – not taken up), an LL.B. from the University of British Columbia, and a B.A. (Hons) from Simon Fraser University. Marke is a Senior Visiting Fellow at the Centre for Commercial Law Studies at Queen Mary, University of London. He is admitted to practice in England and Wales, New York and Ontario. Marke is fluent in French.
