As a member of the Practice Area „Private Client“, Cornelia Maetschke-Biersack advises individuals and their families on all aspects of family and estate law.
In the area of family law, Cornelia specializes in (international) matrimonial planning issues. By their very nature, family issues are sensitive, emotional, and often complex. Cornelia has a wide experience in the negotiation and conception of prenuptial agreements as well as divorce settlements, especially when corporate interests are involved. She also represents her clients in disputes regarding the division of matrimonial assets as well as the granting of alimony to the spouse. Emphasis is always placed on achieving an equitable solution that unifies the often contradictory interests of the parties.
In the area of estate law, Cornelia specializes in the preparation of wills and other contracts relating to wealth transfer planning issues, all in due consideration of the relevant family, estate and private tax law issues. She represents beneficiaries and fiduciaries in the administration of trusts and the estates of decedents, minors and disabled persons. Cornelia also represents individuals in disputes regarding the enforcement and defence of rights to a compulsory portion (“Pflichtteil”). Furthermore, Cornelia advises on the preparation of individual powers of attorney for healthcare matters and general powers of attorney, supplemented with a living will in line with the personal convenience of the client. In the area of healthcare, Cornelia’s field of activity is completed with substantial knowledge in the conception of medical cooperation contracts.
Cornelia studied law at the universities of Munich and St. Gallen, Switzerland graduating in 2004 (First State Exam) and 2007 (Second State Exam) in Munich and Düsseldorf. She was awarded her doctorate on the thesis “Versicherungsbetrug im deutschen und US-amerikanischen Zivil- und Zivilprozessrecht” (insurance fraud in German and American civil law and civil procedure) in 2008. Cornelia joined our office in Düsseldorf in March 2008, where she already has gained experience during her legal training in the areas of family law and the law of succession. In 2011 Cornelia was appointed specialist lawyer for familiy law.
Cornelia is the author of various articles in professional journals with a focus on civil law and civil procedure.
