Energy and Cleantech Industry in Poland

We advise energy companies on the implementation of the legal changes necessitated by the adoption of the EU directives into Polish Law. Our practice extends to the preparation and negotiation of connection and supply agreements, the representation in proceedings before the energy regulatory authorities, in negotiations and disputes with suppliers, in particular take-or-pay clauses, and representation in proceedings before the cartel authorities. Our legal advice in this area covers negotiations with business partners over production sharing agreements and service agreements as well as due diligence and the obtaining of licences and operational approvals. We advise on oil and gas issues and work on solutions for problems in the areas of pipelines and liquid gas.  We also advise companies looking to expand into the markets for biogas and biodiesel.

Due to the constantly changing regulations for the use of renewable energy sources there is increasing interest from investors in this field. There are a number of legal aspects to observe and follow in the preparation of investments such as the construction of plant which can manufacture electricity from renewable energy sources (wind turbines, biomass energy). We support our clients in such situations and advise on areas management, construction law and energy law so that our clients are able to decide whether to proceed with such an investment.
