Nicolai specializes in IT/E-commerce and data protection. His work covers the entire spectrum of IT consultancy ranging from the structuring of technology, particulary software license agrements to outsourcing projects to advising on technology and IP issues in M&A transactions. Further he advises on all aspects of E-commerce and data security/data protection, the latter in particular in relation to market research and customer retention schemes. He also offers advice on all aspects of competition law, advertising law and sponsoring, as well as copyright law. He regularly acts as a lititgator for clients. His clients include inter alia national and international software companies, content providers, portal operators and advertising agencies.

Nicolai studied law in Munich. Following this, he earned an LL.M. - degree at New York University School of Law, where he also worked as a scientific assistant within the university's copyright department. On his return to Germany, he obtained a doctor’s degree in copyright law under the supervision of Prof. Dr. Theo Bodewig and worked as a scholarship holder at the Max Planck Institute for foreign and international patent, copyright and competition law.

Nicolai is co-author of the IT law compendium “Handbuch des Fachanwalts Informationstechnologierecht“ (Luchterhand Verlag 2008). He also regularly publishes articles on IT issues and comments among others, the provisions of the German Unfair Competition Act on comparative advertising in the online commentary of LexisNexis. Nicolai is an acitve member of the German Society of Law and Information (DGRI).
