In Germany, unilateral conduct of a dominant undertaking is restricted by sections 19 and 20 of the Act against Restraints of Competition (ARC; Gesetz gegen Wettbewerbsbeschränkungen (GWB)). Furthermore, article 82 EC Treaty is also directly applicable in Germany according to article 3(1) EC Regulation 1/2003 and section 22(3) ARC. Currently, the main focus in Germany regarding the abuse of dominance lies in the gas sector.
