Simon has been a partner in the Intellectual Property department at Taylor Wessing since 1996. He specialises in patent litigation, licensing and pharmaceutical regulatory work and represents clients in the UK Courts and at the European Patent Office.
Recent cases in which Simon has been involved in include:
- Acting for Amgen and Johnson & Johnson in the extensive patent litigation relating to the genetically engineered erythropoietin (EPO) against Roche Diagnostics and Genetics Institute and Hoechst Marion Rousel and Trankaryotic Therapies was heard by the Court of Appeal in June 2002 and by the House of Lords in 2004 (which overturned the earlier decision and found non-infringement)
- Acting for Merck Generics [UK] Limited (Generics) in a revocation action against Merck & Co. Inc. relating to two patents on alendronate (for osteoporosis). Trial on 5 November 2002. Both High Court and Court of Appeal Judgments in Generics' favour
- Acting for Apotex Inc. (Apotex) of Canada in patent litigation against GlaxoSmithKline relating to paroxetine. Trial in June and July 2003 dealt with both infringement and validity. Judgment in December 2003 in Apotex's favour. Court of Appeal hearing in October 2004 in Apotex's favour
- Nutrinova GmbH v Scanchem, Arnold Suhr and Hope Chemicals. Acting for Nutrinova (part of the Celanese Group of Germany) in a series of patent actions relating to the sweetener Acesulphame-K manufactured in China. The action against Scanchem was Managing Intellectual Property's patent case of the year 2000. Judgement in Nutrinova's favour
- Acting for Cipla and Neolab in patent litigation against Glaxo relating to seretide, a combination treatment for asthma. Judgment in March 2004 held in Cipla's favour
- Acting for Merck Generics [UK] Ltd, an interested party in the High Court judicial review hearing of the MHRA’s policy statement with respect to abridged applications following the ECJ’s decision in Novartis. Application successful
- Acting for Apotex Inc (Apotex) of Canada in patent action against Servier relating to Perindopril. High Court (2007) and Court of Appeal (2008) Judgments both in Apotex’s favour. Enquiry as to damages from injunction period pending
- Acting for Cargill defending a patent action brought by Monsanto in relation to the importation of genetically modified soya meal into the UK (Judgment November 2007).
Simon obtained a BSc in Biochemistry and Genetics from London University and a Diploma in Intellectual Property Law, also from London University (QMW). He lectures and writes regularly on pharmaceutical and biotech patent issues and is the UK correspondent of the Bioscience Law Review.
Simon is listed in Legal 500, Chambers and "Legal Experts" in his field, patent litigation and described as a "bright and effective patent litigator" with "impressive knowledge and expertise" - Chambers 2009.
